Анотація
Проблеми судових стадій чимраз гостріше постають перед їх учасни кам, оскільки зміни і доповнення до чинного кримінального процесуального законодавства вносяться вельми часто, а вироблення правових позицій з тих чи інших неоднозначних правових ситуацій, не говорячи вже про виклю чні правові проблеми, є справою не одного дня, особливо невтішною вигля дає ситуація, коли єдиної позиції немає серед суддів, та більше того, навіть серед різних палат Касаційного кримінального суду Верховного Суду. Не винятком є й така правова проблема, як можливість (неможливість) відкликання обвинуваченим, засудженим апеляційної чи касаційної скарги захисника, так як за КПК 1960 року процесуальні положення у цій царині були більш злагодженими та зрозумілішими, а чинний КПК України цю ситуацію настільки ускладнив, що ні серед науковців, ні серед практиків єдиної позиції щодо можливості відкликання обвинуваченим, засудженим апеляційної чи касаційної скарги захисника поки не напрацьовано.
