Анотація
У статті досліджується об’єктивна сторона та її ознаки кримінального правопорушення щодо нецільового використання бюджетних коштів, здійс нення видатків бюджету чи надання кредитів з бюджету без встановлених бюджетних призначень або з їх перевищенням, на підставі аналізу наукових поглядів, теоретичних положень та законодавства щодо цієї проблеми. Запропоновано визначити об’єктивну сторону ч. 1 ст. 210 Кримінального кодексу України у виді суспільно небезпечного діяння у формі дії: нецільового використання коштів, іншого здійснення витрат державного або місцевих бюджетів чи державних або місцевих позабюджетних фондів чи здійснення міжбюджетного трансферту, вчиненого усупереч закону або рішенню про місцевий бюджет.
