Abstract
The modern economic environment in Ukraine is at the stage of development, which involves the introduction of the necessary terminology. The article is devoted to the justification of the need to introduce and use the term «actual land use» during land technical examinations and expert studies with the specialty 10.7 Land distribution and determination of the order of land use, as well as land management expertise 10.20 Research on land management. The highlighted problem of applied aspects during forensic examinations and expert research is related to the terminological apparatus. The formulation of expert tasks using the concept of «Actual land use» was analyzed, both those contained in the Scientific and Methodological Recommendations on the Preparation and Conduct of Forensic Examinations and Expert Research, and those common in expert practice. The analysis of regulatory and legislative acts of Ukraine on land management and land use was carried out. Various definitions of the terms «land use» available in various information sources have been studied. The geospatial object is described, its features and characteristics are determined, the hypothesis that the actual land use can be considered as a geospatial object is proven, as it has features inherent to a geospatial object. It was established that the concept of land use encompasses the categories of object and process. A comparative analysis was conducted between the land plot and the actual land use, taking into account their features and characteristics. The object and the process of land use were studied. Actual land use as a geospatial object is defined. A comparative analysis of the land plot with the actual land use was carried out according to a number of characteristics. It is proposed to use the terms «actual land use - a part of the earth’s surface that is limited by actual boundaries and is used to meet the needs of land as a spatial basis» and «an actual boundary is a closed conventional line that passes through part of the earth’s surface and limits it by natural or artificial signs caused by actual land use» during forensic examinations and expert studies. The main features of the boundaries of «actual land use» are proposed. A conditional distribution of such features is proposed.
