Abstract
The article is devoted to the problem of domestic violence and establishing the moral suffering of the victim persons in the relevant criminal proceedings. The author describes the presentation of domestic violence in the legislation of Ukraine, provides a detailed list of persons who fall under the category of victim persons in the relevant cases. The practical experience of performing forensic psychological examinations in criminal proceedings regarding domestic violence is analyzed. Attention is drawn to the fact that families in which domestic violence is manifested are dysfunctional. However, it is often the case that one of the partners suffering from domestic violence (or both partners) was brought up in families where domestic violence was typical and acceptable. The author highlights the importance of a detailed study of the life psychological anamnesis of victim persons, in particular, the environment of their growth and upbringing. It is emphasized that the intra-family climate and the model of relations between the child’s parents will definitely shape her perception of marital relations and influence their construction in adult life. The author provides a description of three variants of the influence of the model of disharmonious parental marital relations on the formation of behavior patterns of persons who are victims of domestic violence. The above makes it possible to understand the importance of researching the specified issue for an objective assessment of the moral suffering of the victim person.
