Procedure for appointment and conduct of comprehensive forensic examinations in Ukraine

Abstract

The article deals with the procedural and organizational and legal issues of appointing and conducting complex forensic examinations in Ukraine. The purpose of the study is to develop recommendations for resolving certain problematic issues related to the legal regulation of the procedure for appointing and conducting complex forensic exam inations and involvement of experts who are specialists in various fields and branches of knowledge in complex studies. The author emphasizes that currently, the Ukrainian legislation on forensic expert activity de f ines comprehensive forensic examination only in general terms, with out clear regulation of the procedure for its appointment and conduct. The problems of defining complex forensic examinations are considered from the epistemological and procedural perspectives. The authors draw attention to the current problems associated with conducting complex forensic examinations, the solution of which requires updating approaches to the classification of such examinations and amending the current legal acts regulating legal proceedings and forensic activi ties, in particular, the grounds for appointing complex examinations in various types of legal proceedings, the procedure for involving specialists in various fields of special knowledge and expert specialties in their con duct and the registration of the results of such examinations. Attention is drawn to the need to unify approaches to the concept of “comprehen sive examination” in all branches of procedural law, regardless of the type of proceedings or other forms of proceedings or procedures which provide for the possibility of conducting such examinations and using their results in evidence.
