Abstract

Based on the analysis of the current state of detective activity in Ukraine, the article discusses problematic issues related to the guarantee of fundamental rights, freedoms and legitimate interests and needs of a person. It is concluded that private detective activity can become a full-fledged component of the legal mechanism for ensuring the rights, freedoms and legitimate interests of individuals. The private sector of detective activity in Ukraine is studied; the expediency of its legalization. The experience of foreign countries is considered. The significance of the features of this type of law enforcement activity is highlighted, its individuality and ordinary practice (as well as any other type of economic activity) are emphasized at the same time. Preliminary conclusions about the state of its functioning are made and prospects for further development and ways to improve detective activity in Ukraine are outlined. It is noted that in the current conditions of reforming the legislation of Ukraine on the way to the transition to European and the best world standards, including in the field of protection of human and civil rights, freedoms, in Ukraine there is an increase in demand for detective services. This, in turn, requires the development of detective activity in Ukraine with respect for the rights, freedoms and legitimate interests of individuals, preservation of professional secrecy, confidentiality, interaction with law enforcement agencies, state authorities and local governments, enterprises, institutions, organizations, volunteers and citizens. Having acquired legislative support, private detective activity can become a full-fledged component of the mechanism for ensuring the rights, freedoms and legitimate interests of individuals.
