Abstract
With the legalization of the gambling business, the problem of illegal gambling did not disappear. However, today the player is not recognized as a victim in criminal proceedings regarding the illegal organization or conduct of gambling and cannot use the rights and opportunities to protect his rights, which are provided to the victim in criminal proceedings. Instead, a player of illegal gambling is recognized as an offender and may be held administratively liable. The authors do not agree with this approach. Еhe authors identified the purpose of the article as a scientific solution to the problem of protecting the rights of players in illegal gambling during criminal proceedings under Art. 203-2 of the Criminal Code of Ukraine (illegal activity of organizing or conducting gambling). The article substantiates the importance of attributing illegal gambling business to criminal offenses committed in the sphere of public order and morality, and not in the sphere of economic activity, as well as the importance of identifying the identity of the victim as part of the elements of the forensic characteristics of this criminal offense and the amount of damage caused within the framework of isolating the circumstances, which are subject to proof in criminal proceedings of this category. The authors believe that the criminal offense provided for in Art. 203-2 of the Criminal Code of Ukraine, players may suffer physical, moral or property damage. Such damage manifests itself in the form of problematic or pathological gaming behavior and the moral suffering that such behavior causes, the development of the mental illness ludomania, the loss of money due to losses in illegal gambling.
