Abstract

This article examines the peculiarities of the use of special knowledge during the inspection of the scene of the incident in criminal proceedings regarding the illegal use of humanitarian aid. Attention is focused on the fact that, under martial law, the movement of humanitarian resources is accompanied by complicated documentation, multilink distribution, a combination of paper and digital accounting forms, as well as the expansion of the circle of entities involved in the reception, storage, movement and transfer of humanitarian assistance. Under such conditions, the inspection of the scene goes beyond the usual fixation of the situation, since the objects discovered need to be correlated with documents, accounts and digital traces through which the real movement of the humanitarian resource is reflected. It is established that the use of special knowledge in this investigative action is related to the need for professional interpretation of property information, documentary support, accounting data and electronic forms of accounting. The purpose of the article is to determine the role of special knowledge and the participation of a specialist during the inspection of the scene in criminal proceedings of this category. The methodological basis of the research is the formal-logical, systemstructural and comparative-legal methods, as well as the analysis of investigative practice. The scientific novelty consists in determining the content of the use of specialized knowledge through interrelated areas of research: property, documentary, financial and accounting and digital. The specialist’s participation has been shown to ensure the targeted selection of evidence-relevant objects, the detection of discrepancies between factual, documentary and digital data, and the preservation of the link between the object’s place of discovery and its subsequent investigation. It was concluded that special knowledge during the inspection of the scene in proceedings of this category is a necessary means of fully and accurately establishing the circumstances of the illegal use of humanitarian aid.
