Forensic-expert law: concept, subject, system

Abstract

The article is analyzed a current situation of the legal regulation of forensic activities from the point of view of law theory, business and labor law. It is given characteristic some relations in forensic sciences and general patterns of its legal regulation. Forensic-expert law in its nature is considered an integrated branch of law. It is a sub-sector of the labor law (as forensic activities): it is a specific kind of the professional, business activity of the human being correlating with the last as a part of whole. Forensic activity is an object of legal effect of forensic-expert law. The specific range of public relations is the subject of forensic-expert law, as well as any other branch of law. At the same time forensic-expert relations have already came up through the status of a part of the whole to the independent existence and formed a composite, unique complex of legal relations, which are united with a common goal. It seems appropriate to carry out the delimitation of forensic-expert law from other contiguous branches of law on the basis of a specific system of principles of forensic-expert activity. The imperative method, generally, is the method of forensic-expert law where dominated mostly public relations. Forensic-expert law (as any other branch of law) is not only a set of rules, regulating relations in the field of forensic-expert activities. All norms are interconnected and formed the system with a clear internal structure and the internal division. The above mentioned allows to determine forensic-expert law as a system of complex norms (rules), regulating relations in forensic-expert activities which are established and protected by the state. It is advisable to develop the Code of forensic-expert law which will contain all norms from the different branches of law, laws and some norms of subordinate acts.
